Privacy Policy

Welcome to the website www.werdervigano.ch, operated by Werder Viganò Ltd. ("we"/"us"). We intend to provide information about our firm and to enable you to contact us.

Visiting the website involves the technical collection of data that may relate to you as a user ("you") of our website and its functions. In addition, we process data that you transmit to us when you contact us. All of this is personal data; the processing of such data is regulated by data protection law (however, this data is generally not subject to the professional secrecy of lawyers). Above all, it is important for us to handle it with care. This data protection statement provides you with information on how we do this.

A. What does this notice cover?

This notice applies to data and information that we receive and process through your use of our website. For information about the offers and conditions of other offers and services (such as third-party websites and social media), even if they are linked here, please contact these providers directly.

B. Applicable law

Our data processing is subject to Swiss data protection law.

For visitors residing in the European Union (EU) and the European Economic Area (EEA), the following applies: Switzerland and the EU including the EEA mutually recognize their data protection legislations as equivalent. In certain cross-border cases, EU law, in particular the General Data Protection Regulation (GDPR), may also apply to certain data processing.

C. E-mail contact and other contact

On our website you will find the general contact e-mail address of the firm (law@wvlaw.ch) as well as the e-mail addresses of our employees. It goes without saying that your e-mail address and content that you address to us will be recorded and processed if you contact us by e-mail. The same applies if you contact us in any other way (e.g. by telephone or letter). We keep this data (and for as long as necessary for this purpose) to respond to your inquiries, if necessary further, where we are legally obligated to do so or to protect our rights.

Please note that when you submit your information to us over an open network such as the internet, such networks are generally not considered a secure environment. For example, information sent over the internet (such as on or from the Website or via electronic mail) may be accessed by unauthorized third parties, potentially resulting in disclosures, content changes or technical errors. Even if the sender and recipient are in the same country, information sent over the internet may be transmitted across international borders and forwarded to a country with a lower level of data protection than in your country of residence.

Please note that we do not assume any responsibility or liability for the security of your information while it is transmitted to us over the internet. To protect your privacy, we would like to remind you that you may choose other means of communication with us where you deem appropriate.

D. Server logs

You can also use the website without providing any personal data. However, with each visit to our website you leave – as elsewhere on the internet – a "footprint" of data (so-called server log data), which may include: your connection's IP address and internet service provider, browser request, browser type and versions, languages and the operating system of the device you use to access us, the website you came from (e.g. a search engine where you found us), the individual pages you visit on our website, the date, time and time zone of access, as well as transmitted data volumes. This data is collected by us, as by most website providers, because it may be needed to ensure the security and proper operation of our website; it is not used for any other purpose and is deleted regularly.

E. Cookies

Cookies are set in your browser when you visit our website in order to support certain functions when viewing our website (namely, to store the visitor's language preferences).

G. Security, administration and hosting of the website

We have taken appropriate technical and organizational security measures to protect your personal information that we collect when you visit the website for unauthorized, accidental, or unlawful use.

To protect the security of data transmission, we use common encryption (e.g. SSL) via HTTPS.

We use selected providers in Switzerland for the design and hosting of our website and the associated data, and these are also only hosted on servers in Switzerland. JZ Design GmbH, Baar, is responsible for the administration of the website on our behalf (https://jzdesign.ch/kontakt/). The website is hosted on behalf of Cyon GmbH, Basel (www.cyon.ch).

We have contract agreements with these providers, which ensure the security of the data and our control over it. In our company, only selected employees of the law firm have access to such data.

All employees who access personal data must comply with internal rules and processes relating to the processing of personal data in order to protect it and ensure its confidentiality.

H.  Rights according to GDPR

For our valued visitors from the EU and EEA:

The GDPR would apply if we offer you goods or services or monitor your behaviour. If this is the case, we base processing on the consent of data subjects where we have it. However, we reserve the right to assert an overriding legitimate interest in individual cases anyway, for example if we still need your contact data to communicate with you. Otherwise, we assume such an overriding interest, namely in providing our services, improving our website and analyzing its use for this purpose, and maintaining its secure operation.

Furthermore, you will then have all the rights that the GDPR grants you in this regard (in addition to the practically corresponding rights under Swiss data protection law): You can request from us regarding your personal data that we store and process:

  • information about them, according to Art. 15 GDPR;
  • their correction, insofar as they are incorrect, in accordance with Art. 16 GDPR;
  • their deletion, under Art. 17 GDPR; or their restriction, if they may not be deleted (in which case they are marked to restrict future processing), Art. 18 GDPR – both unless we have an overriding legitimate interest in still retaining and using the data;
  • you can also object to data processing by us; we will then stop this unless there are compelling serious reasons not to do so or we need the data to protect our rights;
  • according to Art. 20 GDPR, you could demand the surrender of such data that you have provided to us based on your consent (these are namely your contact details if you subscribe to the newsletter).
